Our clients may elect any one of the following methods for calculation of attorney fees by negotiating with us by reference to the Shanghai Regulation on Attorney Fees (HFGGF[2017]No. 3) by taking into account the nature of issues, extent of complexity, time devotion and liabilities of attorneys:
In Percentage
If the issue involves a property, the attorney’s fee may be charged according to the following percentages on an accumulative basis based on the value of the property the subject of such case:
Less than RMB 100,000 (inclusive), 8% -12%;
The part greater than RMB 100,000 but less than RMB 1 million (inclusive), 5% - 7%;
The part greater than RMB 1 million but less than RMB 10 million (inclusive), 3% - 5%;
The part greater than RMB 10 million but less than RMB 100 million (inclusive), 1% - 3%;
The part greater than RMB 100 million, 0.5% - 1%.
Case-based charge
Case-based charge shall refer to the manner of charge based on the number of issues handled, which generally is not applicable to issues involving properties.
Time-based charge
Time-based charge shall refer to a manner in which the attorney’s fee is determined according to the hourly rate of attorneys and the number of billable hours of theirs.
Contingency fee
Contingency fee shall refer to the manner where we only receive attorney’s fee where the agreed conditions regarding the issues handled are met, other than those issues to which the government-guided pricing applies.
Notes: specific attorney’s fee provisions shall be set forth in the retainer agreement.
