Attorney Gong is both professional and diligent in his work and gains reliability from his clients. He handled commercial insurance claim disputes, including property, life and health insurance and medical insurance policies disputes. He represented a foreign insurance company in the defense of a lawsuit on a claim under property insurance contract as a result of a damage to a luxury car, in which case the court affirmed that the insurer is not liable after the trials of first instance and second instance and retrial, dismissing the claims of the insured, and the retrial court dismissed the retrial petition of the insured, ultimately the insurance company was exempted from liability damages of about RMB a million; represented that insurer in a litigation filed a foreign-invested construction company over a liability insurance contract dispute, and after the trials of first instance and second instance, the courts held that the insurer is not liable under the policies, which exempted the insurer from liability damages of about RMB 1 million; represented an enterprise management company in the litigation against an insurance company claiming insurance proceeds under an employer liability insurance policy, and achieved a result in favor of his client.
He also successfully handled disputes of real estate, contract and tort, inheritance, private loan and others in favor of his clients. For instance, a house purchase A failed to timely pay one installment of purchase price, and the house owner B deemed that A breached the contract and issued a letter terminating the house purchase and sale contract. After Lawyer Gong was retained, he was of the opinion that although the allegation that A failed to timely pay the purchase price is true, that does not constitute a breach, on the ground that according to the house purchase and sale contract and other related agreements, the title transfer formalities and payment by Party A of that installment of house price should be simultaneously conducted, and since the title transfer failed to be conducted due to the fault of B, the time required for payment of that installment of house purchase price by A should have been extended. Lawyer Gong later represented A in filing a litigation against B requesting he to proceed the performance of the house purchase and sale contract, but B field a counterclaim holding A liable for breach of contract. The court of first instance approved the argument of Gong, ruling to approve the claims of A and dismiss the counterclaim of B. After the trial of second instance, the court upheld the decision of the court of the first instance. Ultimately the house’s title was smoothly transferred to A, and A’s interests are protected to the maximum extent possible.
